FP DIESEL WARRANTY

FP Diesel Engine Parts are warranted to be free from defects in material and workmanship, under normal use and service, for two years from the date of installation in an engine, without mileage or hour qualification. The remedy for breach of this warranty is limited to free exchange of the product shown to our satisfaction to be defective. Liability for neglect, misuse, special, incidental, direct, indirect, and consequential damages is specifically disclaimed. No other warranty, either expressed or implied, including merchantability or fitness for a particular purpose, is made.

Federal-Mogul authorized policy and procedures for this type of an alleged warranty/defective product return are as follows, with no exceptions.

A. Allegedly defective parts require review in advance by a Federal-Mogul sales representative.

B. The parts should be returned in a FP Diesel box and accompanied with either a Federal-Mogul supplied warranty tag or paperwork specifically defining engine owner name, address and telephone, part number, engine application, alleged defect, duration of service, copy of original invoice, and signature of installer or engine rebuilder.

C. No credit will be issued without warranty tag or supporting documentation as noted and approval of a Federal-Mogul sales representative.

D. In the event of a labor claim associated with the defective part, please obtain a Labor Claim Form from a Federal-Mogul sales representative and follow the instructions for further documentation and shipping to product analysis locations.

E. Upon approval, FP Diesel will pay for parts and labor needed to repair engine damages that result from the defined warranty failure. The costs are limited to parts and labor necessary for restoring the engine to its condition immediately prior to the failure. Labor costs are determined by current published rates and standards in the geographic area in which repairs are performed. Overtime or holiday rate charges are not allowed. We will also pay for maintenance products such as oil, anti-freeze, belts, hoses and filter elements that are damaged because of a defined warranty failure.

F. FP Diesel is not responsible for engine failure resulting from owner or operator neglect or abuse, improper installation or repair procedures, alteration or misapplication of parts, or use in engines modified for competition purposes.

G. No warranty/defective credits will be issued for opened boxes that may be resealed and returned to inventory, dirty or damaged packages, or competitor products.

H. Damaged in transit , mispackaged or missing parts are not subject to warranty/defective policy and procedures. Damaged in transit , Mispackaged or missing parts will be exchanged via the Federal-Mogul Distributor.

I. Allegedly Defective product submitted for the purposes of misrepresenting circumstances surrounding the claim (e.g., old parts replaced during the repair returned in a new Federal-Mogul box) will be considered fraud and prosecuted accordingly.
